Appealing orders in family law cases requires quick action once an order is entered by a trial court. The North Carolina Court of Appeals and Supreme Court review the trial court’s order to ensure the District Court Judge did not abuse their discretion or had sufficient evidence to make the decision that is set forth in the Order. When deciding to appeal an order to a higher court in North Carolina you should seek the advice of counsel to determine if the appeal is warranted and that stringent deadlines are met.
The North Carolina Court of Appeals operate under the North Carolina Rules of Appellate Procedure which is different than lower courts in North Carolina. Because of this difference, experience with the appeal process will ensure that the chances of your appeal being dismissed are minimized.
Here at Moen Legal Counsel we pride ourselves on our experience at the appellate level and dedicate part of our practice exclusively to family law appeals. If you desire to schedule a consultation with our office to discuss your potential appeal, please call our office and mention that the consultation is for an appeal.
